General Terms and Conditions

of the Salzburg Ski & Snowboard Schools

These General Terms and Conditions apply to all ski and snowboard schools operating in the province of Salzburg.

 

1. General

Unless expressly agreed otherwise, these General Terms and Conditions apply to all legal transactions and contractual relationships concluded between the Salzburg Ski & Snowboard Schools and their customers as contractual partners.

The purpose of the Salzburg Ski & Snowboard Schools is the operation of snow sports schools, i.e. ski and snowboard schools. This includes the provision of lessons in skills and knowledge of snow sports, in particular skiing and snowboarding (without guaranteeing any specific training success), as well as guiding and accompanying participants in snow sports, especially skiing and snowboarding.

The minimum number of participants for courses is 5 people. If this number is not reached, the ski school reserves the right to make changes. Such changes may concern the number of hours, the price, or other aspects of the course.

A change of instructor due to flexible organization is possible. Private lessons take place in all weather conditions.

Lift tickets are not included in the course price. However, children born in 2020 or later may use the lifts in the Wagrain area (ski school) free of charge with a junior pass.

 

2. Reservations, Offers, Order Confirmations, Conclusion of Contract, Online Price Enquiries and Prices

Reservations for private and group courses can be made in person on site, via the internet, by telephone, or by fax.

All offers of the Salzburg Ski & Snowboard Schools are non-binding.

Acceptance of reservations and the scope of services are determined solely by the written order confirmations of the Salzburg Ski & Snowboard Schools. Oral or telephone side agreements are only valid if expressly confirmed in writing by the respective Salzburg Ski & Snowboard School.

For bookings made on site (private and group courses), a contractual relationship is only established with the purchase or handover of the necessary course ticket. The same applies to bookings made via remote communication methods, whereby the necessary course ticket must be collected by the customer before the start of the service. In all cases, the course ticket will only be issued once full payment has been received prior to the start of the course.

All prices quoted by the Salzburg Ski & Snowboard Schools are in EURO and, unless otherwise agreed, include statutory VAT. Price list information is given without guarantee. No liability is assumed for misprints.

 

3. Terms of Payment

Unless otherwise agreed in writing, for contracts concluded via internet, fax, or other remote communication methods relating to private and group courses, a deposit of at least 50% of the invoice amount is due immediately upon receipt of the written order confirmation. This deposit must be received by the respective ski school’s account no later than three working days before the start of the service. The remaining amount must be paid before the service begins.

If expressly and individually agreed in writing with the respective Salzburg Ski & Snowboard School, the total course fee may also be paid in cash directly to the instructor or to an authorized person of the school immediately before the start of the service.

For contracts concluded at the place of performance, the fee for the service must be paid in the office of the respective Salzburg Ski & Snowboard School before the start of the course, either in cash or using customary electronic payment methods.

In case of late payment, the Salzburg Ski & Snowboard Schools are entitled to claim statutory default interest from the contracting partner.

 

4. Online Offers and Online Bookings

4.1. Content of Online Offers

The ski school / ski rental (hereinafter referred to as "author") assumes no liability for the timeliness, correctness, completeness, or quality of the information provided. Liability claims against the author regarding damages of a material or immaterial nature caused by the use or non-use of the information provided, or by the use of incorrect or incomplete information, are excluded unless the author is proven to have acted with gross negligence or intent.

All offers are non-binding. The author expressly reserves the right to change, supplement, delete, or temporarily or permanently discontinue parts of the website or the entire offer without prior notice.

4.2. References and Links

For direct or indirect links to external websites that are outside the author’s responsibility, liability would only arise if the author had knowledge of illegal content and failed to prevent its use despite technical feasibility and reasonableness.

At the time of linking, no illegal content was apparent. The author has no influence on the current or future design or content of linked pages. Therefore, the author expressly distances himself from all content of linked pages that were changed after the link was set. This applies to all links and references within the author’s website as well as third-party entries in guest books, forums, mailing lists, etc.

Only the provider of the linked site, not the one who refers via links, is liable for illegal, incorrect, or incomplete content and any damages resulting from their use or non-use.

4.3. Copyright and Trademark Rights

The author endeavors to observe copyright in all publications, to use self-created graphics, audio, video, and texts, or to use license-free materials.

All brands and trademarks mentioned on the website and possibly protected by third parties are subject to the provisions of the applicable trademark law and the ownership rights of their respective registered owners. The mere mention does not imply that trademarks are not protected.

The copyright for published materials created by the author remains solely with the author. Any reproduction or use of such materials in other electronic or printed publications requires the author’s explicit consent.

 

5. General Participation Conditions

The customer must truthfully and fully inform the Salzburg Ski & Snowboard School of their abilities and experience in snow sports, especially skiing and snowboarding, at the start of the course. The customer is responsible for having appropriate equipment suited to their skill level and conditions. They must also inform the school of their health status and any conditions that may affect participation.

Before the course, the customer must have their equipment, especially bindings, checked by a professional. The ski school is not liable for damages arising from insufficient inspection, adjustment, or maintenance. Customers are solely responsible for the technical safety of their equipment. Participation may be refused until defects are remedied, without entitlement to fee reduction.

Grouping and classification by skill level is carried out by the school. If reclassification is required, the customer must accept this decision. Otherwise, the school may terminate the contract immediately without refund.

Customers must follow all instructions of the school. Non-compliance, or impairment due to alcohol or drugs, entitles the school to terminate the contract immediately without refund.

If group size falls below 5, the school may merge groups or reduce lesson hours accordingly.

 

6. Liability

Customers are strongly advised to take out health, accident, liability, and travel insurance. The schools are only liable under statutory provisions for damages caused intentionally or through gross negligence in connection with their services.

The schools are not liable if customers disregard instructions, FIS rules, legal regulations, or these terms, resulting in injury, damages, or losses.

 

7. Complaints

Complaints must be reported immediately on site to the school office so that corrective action can be taken. Failure to do so, or failure to complain by the end of the service, forfeits any claims for reduction of fees. Other claims must be submitted in writing within four weeks of arising or becoming known.

 

8. Withdrawal

  • Private Lessons:
    • Cancellation up to 5 days before: 100% refund
    • Cancellation up to 2 days before: 50% refund
    • Cancellation 1 day before or later: no refund
  • Group Courses:
    • Cancellation up to 5 days before: 100% refund
    • Cancellation up to 1 day before: 50% refund
    • Cancellation on the day of or after course start: no refund

Refunds are only possible in case of illness or accident with a doctor’s certificate from a local doctor.

No refund in case of absence, withdrawal during service, or weather-related cancellations (force majeure).

Lift tickets are not included in course fees. No compensation for lost lesson time due to lift or cable car outages.

Incorrectly booked courses or units do not entitle to fulfillment or refund.

 

9. Safety

Participants are expressly reminded that, according to Salzburg state law (1988), children and adolescents up to the age of 15 must wear ski or snowboard helmets conforming to ÖNORM EN 1077:2007 when skiing or snowboarding. Participants must also familiarize themselves with and adhere to the FIS rules.

 

10. Payment Processing

Credit card payments for ski school services are collected by TREKKSOFT AG, Hauptstrasse 15, 3800 Matten, Switzerland ("TREKKSOFT"). TREKKSOFT will appear as TREKKSOFT TOUR BOOKING on your credit card statement. The domain where payments are entered and processed is owned and operated by TREKKSOFT. 11. Place of Performance, Jurisdiction, Governing Law

The place of performance is the location of the ski school’s central office. The competent court at the seat of the ski school’s central office shall have exclusive jurisdiction. Austrian law applies. The contract language is German.

 

12. Legal Validity

Should any provision of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by one that comes closest economically.

Changes to these General Terms and Conditions must be made in writing.
